Update on NFA Rules
I had an interview with the ATF yesterday and we got on the topic of NFA rules.
As of two days ago, you no longer need a trust for suppressors, SBR's and machine guns. They can now goto the individual and DO NOT require CLEO sign off anymore.
They changed the rule as people were abusing the trust and convicted felons and others were added to trusts and gaining access to weapons they should not have access to.
She also stated the many CLEO were not signing off on them unless they were in a trust or not signing off at all, which was part of the issue.
She said they just changed the rule about two days ago and there should be info being posted shortly explaining everything.
It was also stated that they are running 6-9 months right now to clear the checks. They are very backed up.

How Does Final Rule 41F Change Current NFA Regulations?
The final rule affects the NFA regulations by:
- defining the term “responsible person,” as used in reference to a trust, partnership, association, company, or corporation;
- requiring responsible persons of such trusts or legal entities to complete ATF form 5320.23, National Firearms Act Responsible Person Questionnaire and to submit photographs and fingerprints when the trust or legal entity files an application to make an NFA firearm or is listed as the transferee on an application to transfer an NFA firearm;
- requiring that a copy of all applications to make or transfer a firearm, and the specified form for responsible persons (5320.23), be forwarded to the chief law enforcement officer (CLEO) of the locality in which the applicant/transferee or responsible person resides; and
- eliminating the requirement for certification signed by the CLEO.
- (this was important as many CHIEF LAW ENFORCEMENT OFFICERS IGNORED THE LAW OR FLAT REFUSED TO SIGN PAPERWORK, EFFECTIVELY DENYING THE PERSON THE ACCESS TO THE OTHERWISE LEGALLY OBTAINABLE FIREARM
- In addition, the final rule adds a new section to ATF’s regulations to address the possession and transfer of firearms registered to a decedent.
