everyone should watch this, as its very unlikely most of us have to deal with this level of gun ownership restriction,
but its reassuring to know things are slowly changing for the better.
I.E. you can't loose your 2nd amendment rights for NON-VIOLENT, NON FELONEY ,CRIMINAL ACTIONS, without a conviction
"you can't be accused of something by someone, and have your rights removed permanently, due to having that accusation, even before your convicted of the FELONEY action(S)"

TAMPA, FL - On Friday, January 12th, U.S. District Judge Kathryn Kimball Mizelle ruled that a United States law prohibiting people from possessing firearms while inside of a post office goes against their constitutional rights.

According to Fox News, Judge Mizelle, an appointee of former President Donald Trump, cited a 2022 landmark United States Supreme Court decision that expanded gun rights when she dismissed part of an indictment charging a postal worker with illegally possessing a gun in a federal facility.

That landmark case, New York State Rifle & Pistol Association v. Bruen, recognized a person's right to carry a handgun in public for self-defense and established a new test for assessing firearms restrictions, noting it must be "consistent with this nation's historical tradition of firearm regulation."

The indictment against the postal worker, Emmanuel Ayala, was brought forth because of the Smith & Wesson 9mm gun that he kept in a fanny pack with his concealed carry permit. Ayala framed his case around the Bruen decision, arguing that the prohibition against guns in a federal postal facility is "unconstitutional" as applied to him because the "historical record does not support a law banning firearms in post offices."

Mizelle noted that the United States' response to Ayala's claim was that the "Second Amendment allows it to punish the bearing of arms inside any government building." The United States specifically deemed a post office as a "sensitive place," claiming that such a designation means the government can "ban the carrying of firearms while not violating an individual's Second Amendment rights" and is "consistent with the Nation's historical tradition of firearm regulation."

Mizelle rejected that claim, writing, "[Bruen] requires the United States to present historical support for § 930(a)'s application to Ayala, which it fails to do. Post offices have existed since the founding, as have threats to the safety of postal workers and the public entering those locations. Yet the historical record yields no 'distinctly similar historical regulation addressing' those safety problems by regulating firearms in post offices ... Bruen deems this absence strong evidence of the statute's unconstitutionality."

Mizelle sided with Ayala is his claim that the law prohibiting guns in a federal postal facility was unconstitutional, writing, "I dismiss the § 930(a) charge because it violates Ayala's Second Amendment right to bear arms."

Ayala's lawyers stated that he had the firearm while at work for self-defense purposes. Prosecutors said that Ayala brought the gun onto Postal Service property back in 2012 and ran from federal agents when they attempted to detain him. Later, he was indicted on charges. He was charged under a statute that broadly prohibits possessing a firearm in a federal facility, including post offices.

In her decision, Mizelle stated that federal law did not ban guns in government buildings until 1964 and in post offices until 1972. She said there is no historical practice dating back to the 1700s that justifies the ban. The judge said allowing the federal government to restrict visitors from bringing guns into government facilities would allow it to "abridge the right to bear arms by regulating it into practical non-existence."

yes, its all to obvious that anyone who reads and understands to constitution and has read and understood the written explanations, by the countries founders of why the founders wrote most of the constitution's amendments is looked down on by the liberal dems trying to twist and ignore the constitution.

OBVIOUSLY bring up... facts, truth, and logic and actual experience are factors no liberal ever wants brought up in ANY debate




gov statistics show there's now 27 states that have constitutional carry laws IE you don't need a permit to carry a handgun concealed
there's easily three to four times as many weapons in civilian hands as there was in the 1960s yet crime stats show a reduction in violent crime per 100K citizens, and there are now more firearms in civilian hands that people in the USA
there's by the governments estimates at a minimum of 30 million semi auto rifles ("ASSAULT WEAPONS") in civilian hands yet violent crime is lower

Keep in mind the government has only a vague idea how many guns are made, or owned by civilians as of now
(and people have been able build unregistered firearms from parts kit's for at least 4 decades)
people have always built and buy unregistered/ numbered firearms for personal use!
people have been building custom guns, in significant numbers since before the USA was a country

its just a fact, criminals prefer unarmed victims,
if you increase the RISK, to a criminal ,that a potential victim might be armed or bystanders or family members might be armed..
it tends to make criminals more hesitant to try robbing, raping or murdering that potential victim
a well armed population tends to make liberal politicians
nervous...
they can't mandate high taxes and
confiscate property , or force the population to do things most people would not do such as march large populations of political undesirables off to concentration camps
