I just filed our 5th Circuit appeal challenging the federal machine gun ban. We have a similar lawsuit going on in the 3rd Circuit. Take a look if you have a second. I'm not Alan Gura but I'm the best Alan my clients have. Big mahalo to Counsel Press. As a solo practitioner I need to outsource my appellate briefing. the 1986 ban on private companys making any more machine guns, after that date,
that could be sold under direct legal BATF registration and taxing with a back ground check and all other previous safeguards,
is by carefully reading of BOTH BATF and CONGRESSES own admission at the time it was passed,
not able to pass the constitutions second amendment challenge.
it was put in place knowing it could never stand under strict inspection, but thought it could be used, to prevent manufacture until the courts ruled so,
the heller decision made it obviously un-constitutional.
they are NOT suggesting that the BATF can or can,t require the current ,paper work , forms,or back ground check or $200 tax, only that those people meeting the already listed requirements should be approved, not a blanket ban
theres hundreds of thousands of legally owned machine guns , crime with LEGALLY OWNED machine guns is almost NON-existent, youve got a FAR BETTER chance of winning the LOTTO JACKPOT TWICE, in your life time, than being shot with a legally owned machine gun

D. Machine Guns
Under N.C. Gen. Stat. § 14-409, it isl unlawful for any person, firm, or corporation to
manufacture, sell, give away, dispose of, use or possess machine guns, sub-machine guns, or
other like weapons.
A machine gun or sub-machine gun is one which shoots, or can be readily
restored to shoot more than one round, without manual reloading, by a single function of the
trigger. It also includes any frame or receiver of such a weapon, or parts used in converting a
weapon into a machine gun or sub-machine gun. This prohibition does not apply to the
following:

1. Banks, merchants, and recognized business establishments for use in their respective
places of business. However, these persons must first apply to and receive from the
sheriff of the county in which their business is located, a permit to possess the
weapon for the purpose of defending their business;
2. Officers and soldiers of the United States Armed Forces, when in the discharge of
their official duties;
3. Officers and soldiers of the Militia, when being called into actual service;
4. Officers of the State, or county, city or town, charged with the execution of laws of
the State, when acting in the discharge of their official duties;
5. The manufacture, use, or possession of such weapons for scientific or experimental
purposes when such manufacture, use, or possession is lawful under federal laws and
the weapon is registered with a federal agency, and a permit to manufacture, use, or
possess the weapon has been obtained by the sheriff of the county in which the
weapon is located; or Not likely in the county where I live for the Sherrif has posted a Sign saying he wouldn't approve of such.

6. A person who lawfully possesses or owns a weapon in compliance with 26 U.S.C.
Chapter 53, §§ 5801-5871. Nothing limits however the discretion of the sheriff in
executing the paperwork required by the United States Bureau of Alcohol, Tobacco,
and Firearms for such person to obtain the weapon.

Any bona fide resident of the State who now owns a machine gun used in former wars may
retain and keep that weapon at his/ her own property, as a relic or souvenir, without violating the
provisions of this section, as long as the individual reports this weapon to the sheriff of the
county in which he/she lives.


Taxing was a way to regulate the populace from owning automatic weapons from the start when we were in a depression and liquor wars were being fought. Police scared. [NFA] sic You could go to a Sears store and by one for $128.00 in 1934-5-6. Now The Gov'mnt wants no one to own them for fear of a rebellion/ uprising by the citizens . [BATFE] sic A gun trust gets you around all but the manufacture of an automatic weapon which can only be done for a Gov'mnt Agency, military or law inforcement. Even experimental and testing/ of a new gun. BUT you first have to apply for and receive permission to do so by the BATFE, which means you also have to have a several class certifications [ 1 11 11 V V11] !before they will approve the permits . $$$$$$$$

You would be surprised at how many illegal automatic weapons are in the USA, compared to legal owned by individuals, and the Gov'mnt agencies, and people just waiting for the hell to break lose and use them, for most are former military with the best working knowledge of firearms and use of them. All know the risks of owning such a weapon, but most are law abiding citizens just wanting to protect them selves and their families. Just staying hush/hush.

USA has surpassed the 200 year date of a civilized democracy not falling from within. It is close though. All will know by 2016 November election. Or some date in the near future. I predict less than 25 years.
 
its not guns of any type that are the cause of violence, criminals by definition don,t obey laws, its always been a small percentage of the population that ignores laws, and as such have no reason as CRIMINALS by definition, to selectively obey any laws, they pray on any victim they can find.
example
CHICAGO has a long history of strict gun control AND at the same time a history of violence.
criminals, know that as a result of strict gun control honest law abiding citizens, won,t be armed, thus criminals can pray on disarmed victims with little risk of effective resistance.
